Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and Pendova (“Pendova”, “we”, “us”, “our”) and govern your access to and use of the Pendova mobile application, the Pendova website and every related service (together, the “Service”). By creating an account, tapping “I agree”, or using the Service in any way, you accept these Terms, our Privacy Policy, our Refund Policy and our Safety Standards, which are part of these Terms. If you do not agree, do not use the Service.

1. Who Can Use Pendova
- You must be at least 18 years old. Pendova is an adults-only service. We verify age signals, we remove any account we reasonably believe belongs to a person under 18, and we may ask for proof of age at any time.
- You must be legally able to enter into this agreement and must not be prohibited from using the Service under the laws of your country.
- You must not have been convicted of, or be subject to any order relating to, a sexual offence, violence against a person, fraud, or a crime involving minors.
- You must not have been removed from Pendova before, and you must not create a new account to get around a suspension or removal.
- You may hold one account only, registered to your own, working mobile number. Everything you tell us must be true, accurate and kept up to date.
2. Your Account
- Your account is tied to your mobile number, confirmed by a one-time code sent by SMS or WhatsApp. Keep your phone and your codes to yourself; you are responsible for everything done through your account.
- Tell us straight away at info@pendova.com if you believe someone else has used your account.
- You may not sell, rent, lend or transfer your account, and you may not operate an account on behalf of another person.
- You may pause your profile (nobody new sees you) or switch on incognito mode (only members you have liked see you; incognito is a premium feature and switches off when a premium plan ends). Both are controlled from Settings.
3. Your Content and Profile Review
Your content includes your profile photos, verification selfies, stories, bio and other profile text, your answers to in-app questions, and the messages you send through Pendova.
By posting content on Pendova you confirm that it is yours (or that you have permission to use it), that it shows you as you are today, and that it does not break these Terms or anyone else's rights. You grant Pendova a worldwide, royalty-free, non-exclusive licence to host, store, copy, adapt (for example to resize or crop), display and distribute your content for the purpose of operating, promoting, securing and improving the Service. This licence ends when you delete the content or your account, except where we must keep it under section 7 or the law.
Profile review is part of the Service. Before or after it is shown to other members, your content may be checked by our team and by automated systems, including artificial-intelligence tools, against our rules. In particular:
- Profile photos and bios are reviewed before they become visible, and may be rejected or removed at any time.
- Stories are reviewed (by our team, by automated review, or both) before they are shown and may be rejected without being shown.
- Photo verification compares your verification selfie with your profile photos. A verified badge is withdrawn if we later have reason to doubt it.
- We may remove or refuse any content that is sexual, violent, hateful, illegal, misleading, not of you, or that includes phone numbers, usernames, links or advertising.
4. Community Rules
Pendova exists so adults can meet honestly and safely. While using the Service you must not:
- Ask any member for money, airtime, fares, gifts, loans, bank or mobile-money transfers, investments or "deposits", or send anyone a scam script of any kind.
- Offer, request or arrange paid sexual services or "arrangements" of any kind.
- Threaten, stalk, blackmail, harass, bully, insult or discriminate against anyone, or threaten to share anyone's photos, messages or private details.
- Send sexual messages or images to a member who has not clearly welcomed them.
- Pretend to be someone you are not, use photos that are not of you, lie about your age, or run more than one account.
- Use Pendova to advertise, sell, recruit, promote another service or channel, or to collect members' contact details or data.
- Send the same message to many members, like profiles in bulk, use automation, bots, scripts or modified apps, or interfere with the Service or its security.
- Post or share anything involving a person under 18, anything illegal, or anything that encourages harm.
- Share another member's photos, messages or details outside Pendova without their consent.
- Make false reports about other members.
Breaking any of these rules is a material breach of these Terms. Section 7 explains what we do about it.
5. How Pendova Shows Profiles
- Who you see depends on your location (or a travel location you choose on a premium plan), your filters, your activity, and the profiles' own status (approved, paused, incognito, suspended). The order is decided by Pendova and includes elements of chance, promotion of boosted or spotlighted members, and priority for members who are new or active.
- We do not promise that any particular member will be shown to you, that you will be shown to any particular member, or that you will receive any number of likes, matches, messages or meetings.
- Free use of the Service includes limits, for example on the number of likes within a period of time, on seeing who liked you, and on contact reveals. The limits, and what each plan or add-on includes, are shown in the app and may change.
- Pendova may operate accounts run by Pendova itself for testing, quality checks, welcoming new members and keeping the Service safe. Such accounts are marked internally, are never used to ask for money or personal details, and are not real members looking to date.
- Your phone number is private by default. It is shared only when you make it visible, or when you approve a request from another member, or through a contact-reveal feature you use. Once a number has been shared, we cannot take it back from the person who received it.
6. Safety and Your Interactions
- Pendova does not run criminal-record or background checks on members and cannot confirm that any member is who they say they are, even with a verified badge. You alone decide whether to speak to, share information with, or meet anyone.
- Never send money or anything of value to a member. Pendova never asks for payment through chat. Read our Safety Standards before meeting anyone in person.
- You are solely responsible for your interactions with other members, on and off the Service. Pendova is not responsible for anything a member says or does, and is not a party to any arrangement between members.
- Use the report and block tools in the app. Reports are confidential: we do not tell a member who reported them.
7. Moderation, Suspension and Removal
How we find problems. We watch for behaviour that may harm members using reports and blocks from other members, patterns of use (for example the same message sent to many people, unusually high numbers of likes, very new accounts contacting many members), the content of profiles and stories, and the content of messages. Automated systems, including artificial-intelligence review, score this information and flag accounts. A trained member of our team reviews flagged accounts and decides. When an account is flagged, our team may read the account's messages, reports and profile history to the extent needed to decide. Every such review is logged.
What we may do. If we reasonably believe that you have broken these Terms, our Safety Standards or the law, or that your account puts other members, Pendova or the public at risk, we may take any of the following steps at any time, with or without notice:
- remove or refuse content, withdraw a verified badge, or hide your profile from other members;
- limit features (for example likes, messaging, contact reveals, stories or boosts);
- suspend your account for a fixed period (normally 7 days or longer; the end date is shown in the app) during which your profile is hidden and you cannot use the Service;
- delete your account permanently, including where fraud, a scam, a threat, a sexual-services offer, impersonation, a person under 18, or repeated or serious harassment is identified. Pendova's decision on what counts as a serious breach is final.
Deleted for a breach. When we delete an account for a breach: the profile disappears from the Service and the member is signed out of every device; the mobile number used for the account is barred from creating a new account; no refund is due for any plan, boost, add-on or other purchase, and any remaining plan time is forfeited; the member may not open another account with a different number, device or identity, and any such account will be removed without notice; and we keep the account's records (section 7 below and the Privacy Policy) so that we can prevent the member from returning, deal with any complaint or claim, and help law enforcement where the law requires or allows it.
Records. We keep records of reports, moderation decisions, suspensions and deletions, and the content and account data they relate to, for as long as needed to run the Service safely, to resolve disputes, to comply with the law and to stop removed members from returning. Deleting the app or your account does not delete these records.
Authorities. We may report threats, scams, child-safety concerns and other crimes to the police or other authorities, and we may share account information with them where the law requires or permits.
Mistakes happen. Automated and human review can be wrong. We review every suspension and deletion on request (section 8), and we will reverse a decision that turns out to be unfounded. Pendova is not liable to you for a suspension or removal made in good faith.
8. Appeals
- If your account is suspended or deleted and you believe we got it wrong, write to info@pendova.com within 30 days of the decision, from the mobile number or email on the account, with anything that helps us understand what happened.
- A different member of our team will look at your appeal and answer within 14 days. Their decision is Pendova's final decision on the matter.
- An appeal does not pause a suspension and does not restore a deleted account while it is being considered.
9. Paid Services
- Pendova offers premium plans (for a week, a month or three months), boosts and spotlights, contact-reveal add-ons and other paid features. What each one includes, its price in your currency and its duration are shown before you pay. Prices differ by country and may change; a change never affects a purchase you have already made.
- Payments are taken by Google Play, the Apple App Store, or payment providers we work with (such as mobile money and card processors). Their terms also apply to the payment. Pendova does not store your card or mobile-money credentials.
- A plan starts when the payment is confirmed. If you buy a plan while another plan is running, the new plan starts when the current one ends, so no paid time is lost.
- Plans do not renew automatically, whichever way you pay: a plan ends at the end of its period and you choose whether to buy another. We may remind you shortly before a plan ends.
- Boosts, spotlights and add-ons are used up as described in the app and are not transferable.
- Purchases are final and non-refundable except as set out in our Refund Policy or as required by the law of your country. No refund is given, and remaining time is forfeited, when an account is suspended or deleted for breaking these Terms.
- Buying a paid feature does not exempt you from any rule, limit or moderation decision.
10. Communications
- We send service messages you cannot opt out of while you have an account: one-time codes, security notices, moderation decisions, payment receipts and changes to these Terms. We send them by SMS, WhatsApp, email, push notification or in the app.
- We may also send you tips, reminders and offers by SMS, email, push notification or WhatsApp. You can stop these at any time from Settings, by replying STOP to an SMS, or by using the unsubscribe link in an email, and we honour that choice.
11. Ending Your Account
- You can delete your account at any time from Settings in the app, or by writing to info@pendova.com from the number or email on the account. Your profile is removed from the Service straight away. What happens to your data after that is explained in the Privacy Policy.
- Deleting your account ends any plan, boost or add-on that is still running; the time left is not refunded, except where the law requires it.
- We may close accounts that have been inactive for a long period after giving notice to the contact details on the account.
- Pendova may also end these Terms, or stop offering the Service or any part of it, at any time. Sections 3 (licence to keep what the law requires), 7, 9, 12, 13, 14, 15 and 16 survive the end of your account or of these Terms.
12. Intellectual Property
- Pendova, its apps, website, logo, design, text, software and everything we create (excluding your content and other members' content) belong to Pendova or its licensors and are protected by copyright, trade-mark and other laws.
- We give you a personal, limited, revocable, non-transferable licence to use the app and website for their intended purpose, in line with these Terms. You may not copy, modify, decompile, scrape, resell or build on any part of the Service without our written permission.
- Other members' photos, messages and details are theirs. Copying, screenshotting to share, or publishing them outside Pendova without their consent is a breach of these Terms and may be unlawful.
13. Disclaimers
- The Service is provided "as is" and "as available". To the fullest extent the law allows, Pendova gives no warranties of any kind, express or implied, including about accuracy, reliability, availability, fitness for a particular purpose, or the conduct, identity or intentions of any member.
- We do not guarantee that you will find a match, a relationship, a meeting or any particular outcome, that any member is genuine, or that the Service will be uninterrupted, secure or free of errors.
- Our moderation tools reduce risk; they cannot remove it. You accept that some members may still behave badly and that you remain responsible for your own safety.
14. Limitation of Liability
To the fullest extent permitted by law:
- Pendova, its owners, directors, employees, contractors and partners are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising out of or connected with the Service, these Terms, or the conduct of any member or third party, whether in contract, tort (including negligence), under statute or otherwise, even if we were told such damages were possible.
- Pendova is not liable for anything a member does or says, online or offline, or for any loss you suffer from meeting, trusting, paying or sharing information with a member.
- Our total liability to you for all claims together will not exceed the amount you paid Pendova in the 12 months before the claim arose or, if you paid nothing, KES 5,000 (or the equivalent in your currency).
- Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.
15. Your Responsibility to Us
You agree to defend, indemnify and hold harmless Pendova, its owners, directors, employees, contractors and partners from any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms or the law, or your interactions with any other member or person.
16. Governing Law and Disputes
- These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law rules. If you live elsewhere, mandatory consumer-protection rules of your country that cannot be excluded by agreement still apply to you.
- Before starting any claim, you agree to contact us at info@pendova.com and to try in good faith to resolve the matter with us for at least 30 days.
- Any dispute that cannot be settled this way will be referred to arbitration in Nairobi, Kenya, by a single arbitrator under the Arbitration Act of Kenya, conducted in English. Either party may instead bring a claim in the courts of Nairobi, Kenya, which you agree have jurisdiction. Nothing stops either party from seeking urgent injunctive relief in any competent court.
- Claims must be brought individually, not as part of a class or representative action, to the extent the law allows.
- If any part of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a right is not a waiver of it. These Terms, with the policies they refer to, are the whole agreement between you and Pendova about the Service.
17. Changes to These Terms
- We may change these Terms. For significant changes we will tell you in the app, by push notification, SMS or email at least 7 days before they take effect, unless a change is needed sooner for legal or safety reasons. The "Last updated" date at the top shows the current version.
- If you keep using the Service after a change takes effect, you accept the new Terms. If you do not agree, delete your account before that date.
